La Ley Hipotecaria y el texto refundido de la Ley del Catastro Inmobiliario, tras su reforma por la Ley 13/2015, de 24 de junio, establecen un sistema de coordinación entre el Catastro Inmobiliario y el Registro de la Propiedad, para que éste incorpore la descripción gráfica georreferenciada de las fincas registrales, utilizando como base la cartografía catastral. Con ello se persigue dar mayor seguridad a los datos de ubicación, delimitación y superficie de las fincas registrales que son objeto del tráfico jurídico.
Los requisitos técnicos para el intercambio de información y una mejor coordinación entre el Catastro y los Registros de la Propiedad se han desarrollado mediante Resolución conjunta de las Direcciones Generales del Catastro y de los Registros y del Notariado, que entró en vigor el 1 de noviembre de 2015.
Desde esta fecha, coincidente con la entrada en vigor de la reforma legal, la descripción de las fincas en el Registro de la Propiedad podrá venir acompañada de la representación gráfica georreferenciada de la parcela, de acuerdo con la información que suministrará el Catastro, basada en el formato europeo INSPIRE de parcela catastral. Con ello se permitirá identificar sobre plano la situación, forma y superficie de la finca registral, superándose la situación anterior en que la mayoría de las fincas registrales se describían únicamente de manera literal.
El ciudadano puede solicitar voluntariamente la incorporación en el Registro de la representación gráfica catastral tanto con ocasión, por ejemplo, de una compraventa, como en cualquier momento, sin necesidad de esperar a la inscripción de un nuevo acto. Será, en cambio, necesaria la representación gráfica para realizar la inscripción de operaciones que supongan una reordenación de los terrenos, tales como segregaciones, agrupaciones o reparcelaciones así como en la inmatriculación de fincas.
Cuando no se estuviera de acuerdo con la representación gráfica catastral se puede aportar una representación gráfica alternativa, la cual, una vez inscrita en el Registro de la Propiedad, podrá dar lugar a la oportuna rectificación en el Catastro Inmobiliario.
Esta coordinación es clave para incrementar la seguridad jurídica en el tráfico inmobiliario ya que, una vez incorporada la información catastral, se presumirán ciertos a todos los efectos legales los datos de delimitación, ubicación y superficie de la representación gráfica de la parcela inscrita. En la publicidad que otorgue el Registro de la Propiedad se indicará si la finca está coordinada con el Catastro y en qué fecha. Supone, además, una reducción de cargas administrativas: el ciudadano no tendrá que declarar ante el Catastro todos los datos que le sean comunicados por el Registro de la Propiedad.
En una apuesta por la Administración digital, el suministro de información se realizará a través de servicios web entre la Sede Electrónica del Catastro y la del Colegio de Registradores de la Propiedad y Mercantiles de España. Además, los ciudadanos y técnicos competentes disponen también de los servicios informáticos precisos para la obtención de la información catastral o para la elaboración de la representación gráfica georreferenciada sobre la información catastral.
